Acceptance of these terms
These Website Terms and Conditions ("Terms") govern your access to and use of www.xplore.solar and associated Xplore Solar webpages, forms, tools, scheduling experiences and communications (collectively, the "Services"). The Services are provided by Xplore Solar, LLC ("Xplore Solar," "we," "us" or "our").
By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services. You must be at least 18 years old and legally able to enter into these Terms.
Educational and preliminary information
Website content is provided for general educational and informational purposes. It is intended to help homeowners understand solar concepts, ownership structures, agreements and potential next steps. It is not legal, tax, accounting, engineering, investment or financial advice and is not a substitute for reviewing the specific documents and facts applicable to a home.
A website page, Roof Score, eligibility question, appointment or preliminary conversation is not an offer, final system design, credit decision, savings analysis or guarantee that a home or homeowner qualifies.
Xplore Solar's role
Xplore Solar provides homeowner education, initial qualification support, referral and project coordination. Independent providers may supply financing or third-party ownership, equipment, technical design, installation, monitoring, service, warranties and related products. The identity and responsibilities of the parties to a solar project will be stated in the applicable written agreements.
Any solar lease, power purchase agreement, financing agreement, installation agreement or other project contract is separate from these Website Terms. If these Terms conflict with a signed project agreement regarding that project, the signed project agreement controls.
Availability, estimates and no guarantees
Solar availability depends on location, utility territory, property ownership, roof and electrical conditions, energy usage, provider criteria, credit or other qualification requirements, permitting, interconnection rules and current partner coverage. Programs, rates, incentives and agreement terms can change.
Xplore Solar does not guarantee qualification, approval, installation timing, system production, utility-bill reduction, savings, property value, tax treatment, incentives, rebates, uninterrupted service or any particular financial outcome. Illustrations and estimates are not promises of future results.
Roof Score and property information
The Xplore Roof Score uses available third-party mapping, roof geometry and sunlight data to provide an early informational assessment. Imagery and data may be incomplete, dated or unavailable. The result is not a site survey, structural analysis, engineering design, shade study, proposal or confirmation of eligibility.
You are responsible for entering a complete and accurate address and for obtaining an on-site or professional evaluation before making a project decision. Xplore Solar may modify, suspend or discontinue the tool at any time.
Forms, appointments and user information
When you submit a form, request an appointment or provide information, you agree that the information is accurate, current and yours to provide. You may not impersonate another person, submit another person's contact or property information without authorization, interfere with the Services or use the Services for unlawful, fraudulent or abusive purposes.
An appointment request is not confirmed until confirmation is provided through the scheduling experience, email, text or another communication. You are responsible for reviewing appointment details and updating us if your availability changes.
Calls, text messages and email
If you provide a telephone number and affirmatively submit a form containing communication consent language, you authorize Xplore Solar and service providers acting on its behalf to contact you about your request by call or text message, including through automated technology where permitted by law. Message frequency varies. Message and data rates may apply. Consent to marketing communications is not a condition of purchase.
Reply STOP to opt out of marketing texts and HELP for help. Use the unsubscribe link in a marketing email to stop marketing emails. An opt-out applies to the applicable communication channel and does not prevent communications required to respond to an active request, complete an appointment or satisfy legal obligations.
Third-party websites and services
The Services may contain links to or integrations with third-party websites, videos, mapping services, scheduling platforms, solar providers, installers and other services. A link or integration does not mean Xplore Solar controls or guarantees the third party. Your use of a third-party service may be governed by separate terms and privacy policies.
Xplore Solar is not responsible for third-party content, availability, acts, omissions, products, agreements or services except to the extent responsibility cannot legally be excluded.
Intellectual property
The Services, including the Xplore Solar name and branding, website design, text, graphics, videos, tools, compilation and other content, are owned by or licensed to Xplore Solar and are protected by intellectual-property laws. You may use the Services for personal, non-commercial evaluation of solar options.
You may not copy, reproduce, distribute, sell, scrape, reverse engineer, frame, republish, modify or create derivative works from the Services without prior written permission, except as allowed by law.
Prohibited conduct
- Use the Services for unlawful, deceptive, abusive or fraudulent activity.
- Attempt to gain unauthorized access to systems, accounts, data or non-public portions of the Services.
- Introduce malware, overload the Services, automate excessive requests or interfere with another person's use.
- Use website content or data to build a competing database, train a commercial system or solicit Xplore Solar users without permission.
- Misrepresent affiliation with Xplore Solar or use our branding in a misleading manner.
- Submit sensitive information that a form does not specifically request.
Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." XPLORE SOLAR DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES REGARDING THE SERVICES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY AND RESULTS.
We do not warrant that the Services will be uninterrupted, error-free, secure or complete, or that defects will always be corrected. Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, XPLORE SOLAR AND ITS OFFICERS, MEMBERS, EMPLOYEES, CONTRACTORS AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST SAVINGS, LOST DATA OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, XPLORE SOLAR'S TOTAL LIABILITY ARISING FROM OR RELATED TO THE SERVICES OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS. These limitations do not apply where liability cannot legally be limited or excluded.
Indemnification
To the extent permitted by law, you agree to defend, indemnify and hold harmless Xplore Solar and its officers, members, employees, contractors and agents from claims, liabilities, losses, damages and expenses, including reasonable attorneys' fees, arising from your unlawful misuse of the Services, violation of these Terms or infringement of another person's rights.
Changes, suspension and termination
We may update the Services or these Terms from time to time. Updated Terms become effective when posted with a new effective date. Continued use after that date means you accept the updated Terms.
We may restrict or terminate access to the Services where reasonably necessary to protect the Services, Xplore Solar, users or others, or when we believe these Terms or applicable law have been violated.
Governing law and general terms
These Terms are governed by applicable United States law and the laws applicable to Xplore Solar's principal place of business, without regard to conflict-of-law principles. Any dispute not resolved informally must be brought in a court of competent jurisdiction, except where applicable consumer law requires otherwise.
If a provision of these Terms is found unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. These Terms and the Privacy Policy are the entire agreement concerning use of the Services, apart from any separate written project agreement.
